Harsher penalties for assaulting responders and officials

The law makes simple assault a class C felony in certain cases. It applies when the victim is a peace officer or a correctional employee on duty and the attacker knows that. It also applies when a state hospital employee is on the job and the attacker is someone committed or detained at the state hospital under chapter 25-03.3. It covers people engaged in a court proceeding. It also covers firefighters, EMS, emergency department workers, and hospital workers giving essential patient care while on duty. In all other cases, simple assault is a class B misdemeanor.

Simple assault definition and charges

The law defines simple assault. You commit it if you willfully cause bodily injury to another person. You also commit it if you negligently injure someone with a gun, a destructive device, or another weapon likely to cause death or serious injury. These acts are crimes under state law.
