Online ads count as pet food labeling

The law broadens what counts as labeling for commercial feed, including pet food. Written, printed, and graphic materials now include promotions on radio, TV, websites, and other internet interfaces. Companies must ensure these materials meet labeling rules.

Pet food sellers: register and pay fees

Before you sell pet food or specialty pet food in North Dakota, each product must be registered with the commissioner. Distributors do not re-register if someone else registered the product. Registration costs $120 per product made outside the state and $50 per product made in-state; renewal is $100 per product. Registrations run from January 1 of even-numbered years through December 31 of the next odd year. If you miss renewal by more than 31 days, you must apply again for an initial registration. The certificate cannot be transferred, and the penalty is $25 per unregistered product. You are exempt only if you live in North Dakota, make the food in a noncommercial kitchen, sell directly at a community event or farmers market, and use no meat, poultry, fish, or their byproducts.
