Higher death benefits for workers’ survivors
North Dakota raises the total workers’ compensation death benefit cap from $300,000 to $400,000 per claim, including supplementary benefits. The higher cap applies to deaths caused by injuries occurring on or after the law’s effective date. Eligible survivors can receive more when their claim reaches the old limit, but total payments cannot exceed $400,000.
Higher scholarships through workers’ compensation
The workers’ compensation scholarship limit rises from $10,000 to $12,500 per applicant each year. Payments remain limited to five years, and total scholarship awards remain capped at $500,000 annually. For applicants who successfully complete the specified rehabilitation program, retraining and scholarship periods together cannot exceed five years.
Workers’ disability depends on actual lost earnings
North Dakota defines workers’ compensation disability by actual earnings lost because of an injury, replacing the lost earning-capacity standard. Disability can be permanent total, temporary total, or partial. The new measure can change whether injured workers qualify for benefits and how much they receive.
Electronic claim notices and firm appeal deadlines
North Dakota Workforce Safety and Insurance can send claim forms, notices, and orders by mail or electronically. The 45-day reconsideration period runs from the notice’s issuance. Written rehearing requests must reach the agency within 45 days after the order is issued. When decision review office assistance applies, that deadline runs from its completion notice, which can also be sent electronically. Requests count as filed only when received and must list each claimed factual or legal error and the relief sought.
