AN ACT to amend and reenact sections 65-01-02, 65-01-16, and 65-02-27, subsection 1 of section 65-05-17, and subsection 4 of section 65-05-20.1 of the North Dakota Century Code, relating to the definition of disability, the definition of electronic means, forms and decisions issued by electronic means, requests for rehearing of an administrative order, maximum death benefits, and the scholarship fund; and to provide for application.

Higher workers' comp death benefits

The law raises the total workers' comp death benefit cap from $300,000 to $400,000 per claim. On July 1 of each odd-numbered year, the cap goes up by $10,000. Each increase applies from that July 1 through the next June 30. The higher caps apply to deaths from injuries that happen on or after the law’s effective date.

Larger retraining scholarships for workers

You can get up to $12,500 in scholarship money per year for up to five years. All scholarships together remain capped at $500,000 per year. If you complete a WSI rehab program, your total time in retraining plus scholarship cannot be more than five years.

Clearer deadlines for workers' comp appeals

The organization may send decisions and orders by mail or electronic means, and deadlines start when they are mailed or issued. You have 45 days to request reconsideration of a decision, and 45 days to request a rehearing after an order or after the review office finishes helping you; requests count only when received and must list errors and the relief you want. You also have 45 days from the mailing date of an administrative order to ask the review office for help. If the organization does not issue an order within 60 days after your reconsideration request, you can ask for an appealable decision.

New decision review office for workers

The law creates an independent decision review office to help injured workers with disputes. Staff can help and speak for you but are not your lawyer. If you ask the office for help during your hearing window, your hearing deadline pauses until the office says its help is done. Your communications and the office’s notes are private. The organization will not pay your attorney unless you first try to resolve the dispute through this office.
