North Dakota deeds must list description drafter

County recorders do not record a deed or contract for deed with a metes-and-bounds description that affects title or possession unless it legibly shows the name and address of the person who drafted that description. A document complies if it states: "The legal description was prepared by (name) (address) or obtained from a previously recorded instrument." If the description was taken from a previously recorded document, the recorder cannot reject it for that reason. This rule does not apply to instruments signed before January 1, 2000, or those signed or acknowledged outside North Dakota. A missing statement does not reduce the legal effect of an instrument that is already recorded.
