Ban on rental discrimination by licensees

Real estate licensees must not discriminate in hiring, sales, or rentals based on race, color, creed, or national origin. Violating state or federal anti-discrimination law is prohibited. In hearings, a certified final court judgment or agency order is conclusive evidence.

More education hours for real estate licenses

To get a New Hampshire real estate license, you must complete 60 approved credit hours before your exam. For renewal, all licensees must take a 3-hour core course. Active licensees must also complete 12 elective hours. New salespersons must finish 12 initial hours before their first renewal, in topics set by the commission. Core courses cover changes in real estate and housing laws, financing, consumer protection, and zoning rules.

Tougher discipline for real estate pros

Convictions for listed crimes count as prohibited conduct even when based on a guilty plea, nolo contendere, or a deferred or suspended sentence, unless annulled under RSA 651:5. Licensees found guilty after a hearing face discipline under state law. Accredited instructors who commit listed acts can be disciplined after a hearing. Out-of-state brokers or salespeople who break these rules are in violation of RSA 331-A:34.

Inactive license rules and past pay

You may place your license on inactive status by written request. While inactive, your former broker can pay you for deals or referrals you worked on while active. You must renew every two years and meet continuing education rules while inactive. You do not need a place of business, and inactive principal or managing brokers do not need a surety bond.
