Pharmacists can substitute lower-cost biologics

Beginning 60 days after passage, pharmacists may give you an interchangeable biologic instead of the one written on your prescription. The swap only occurs for products the FDA lists as interchangeable or therapeutically equivalent. This can lower what you pay if a covered lower-cost option exists.

You or your doctor can block a switch

A pharmacist cannot substitute if your prescriber marks the prescription “medically necessary,” uses an equivalent electronic or oral instruction, or says so when calling in. You can also tell the pharmacist you do not want a substitute. Blocking a swap can keep you on the original brand and may cost more.

Clear labels and FDA info on biologics

Labels on dispensed biologics must show the product’s proper (nonproprietary) name and the maker. The law defines what counts as a biological product and what “proper name” means, using FDA terms. The Board of Pharmacy must link to the FDA lists of licensed, biosimilar, and interchangeable products.

You get notice; your doctor is told

If an interchangeable biologic is dispensed, the pharmacist or their designee must tell you. Within 3 business days, they must record the exact product name and maker in a system your prescriber can access, or contact the prescriber. They do not need to notify when no interchangeable exists or when a refill is unchanged.
