Annual public reports on state funds
Every administrator of a listed fund, account, or trust must file a yearly report by October 15. The Commissioner of Administrative Services compiles these into a searchable report by November 15 and sends it to state leaders and committees. People and groups can also ask the State Treasurer to open and separately manage new trust, endowment, custodial, or escrow accounts.
Clear rules for custodial and escrow
The law clarifies that custodial funds are owned by someone else and held by the State as a fiduciary. The State must keep assets safe, handle transactions, collect income, and send money to the named beneficiary on time. It lists specific custodial and escrow accounts, such as private postsecondary school deposits, Yellow Transportation and Crown Paper labor escrows, and the Electric Assistance Program Fund. These accounts stay separate from general revenue.
Clearer rules for dedicated state funds
The law keeps dedicated funds separate from general revenue. Money the State Treasurer receives is treated as general revenue unless a specific law makes it a dedicated fund, trust, or custodial account. It cleans up old, overlapping fund lists so the statute matches the new categories and headings.
Dedicated funds for water projects
Money in the Department of Environmental Services’ water resources project accounts is kept separate from general revenue. Money in the Drinking Water Groundwater Trust Fund is also kept separate. DES and the State Treasurer must maintain these dedicated statuses.
More state trusts listed and protected
The law adds and protects many trust, permanent, and endowment funds. Examples include the Fox Forest trust funds, land conservation and community conservation endowments, the higher education endowment, the Guy Thompson account at the veterans’ home, and youth development center trust funds. These are managed as dedicated funds, separate from general revenue.
