More support for utility commission, one duty dropped
The Department of Energy must provide the support required by state law (RSA 21-G:10) to the Public Utilities Commission, the Site Evaluation Committee, the Office of the Consumer Advocate, and other attached entities. The law also repeals a prior duty in RSA 12-P:2, III.
Stronger state role in utility cases
The Department of Energy can investigate utility matters and appear before the Public Utilities Commission (PUC) to argue its position. When it files a notice, it becomes a full party and can appeal PUC decisions. Anyone who starts a PUC case must serve the Department at filing, and must share confidential materials in cases where the Department may appear. In formal adjudicative cases, the PUC and the Department follow state adjudicative hearing rules (RSA 541-A:36). The Department can order utilities and other regulated entities to give documents and specific answers on a deadline it sets. These changes take effect 60 days after passage.
