Licensing and inspection rules for homestead sellers
The law exempts homestead sellers from state licenses and routine inspections when they sell non‑potentially hazardous foods from home, their farm stand, farmers’ markets, or retail food stores. The health department can still inspect if it suspects an imminent health hazard. To sell non‑potentially hazardous food to restaurants or other retail food establishments, online, by mail order, or to wholesalers for resale, you must be licensed by the Department of Health and Human Services. The department will set the licensing steps and standards by rule. These changes take effect 60 days after passage.
New labeling rules for homestead foods
The law requires homestead food sellers to label every packaged item. For sales from your home or farm stand, you must put your name, address or email, phone, product name, allergy info, and ingredients on the package. Or you may show a QR code or website for ingredients and post the ingredient list at the display. For packages sold at markets, to restaurants or retail stores, online, by mail, or to wholesalers for resale, your label must list your contact info, product name, ingredients by weight, and allergy info. All packages must also state your status: “This product is exempt from New Hampshire licensing and inspection.” or “This product is made in a residential kitchen licensed by the New Hampshire Department of Health and Human Services.” These changes take effect 60 days after passage.
