Stronger enforcement for divorce property settlements

Beginning January 1, 2026, when you file to enforce a final divorce property settlement or decree (or for contempt), the court enforces it as written. The court must do so unless someone proves, by a preponderance of the evidence, fraud, duress, deceit, impossibility, misrepresentation, mutual mistake, undue influence, or that it later became illegal. The court orders remedies that put you where you would be if the decree had been followed, like returning property or paying money owed. These rules apply to motions filed on or after January 1, 2026, even for older divorce decrees.
