Law starts 60 days after passage

The law takes effect 60 days after it is passed. Towns and the public follow these rules after that 60‑day period.

Select boards run town property and short leases

The law gives the select board control over town real estate. The board manages use of town land unless voters assign it elsewhere or another state law controls. The board can rent or lease property when it is not needed for public use. For leases of one year or less, the board may approve them without a town meeting vote.

Voters must approve long town leases

For leases longer than one year, up to 99 years, town voters must approve them by a 3/5 vote at an annual or special meeting. The vote is by ballot and not on the officer‑election ballot unless the town uses an official ballot form of meeting or a charter under state law. Polls stay open and accept ballots for at least one hour after discussion. Voters may also, by a 3/5 ballot vote, give or take back the board’s power to lease property for terms up to five years; that grant stays in effect until rescinded. If voters rescind that power, any leases already signed stay in effect.
