Longer protection for approved development plans
Beginning July 1, 2025, approved and recorded subdivision plats and site plans are protected from later local rule changes for 7 years (up from 5). This applies to approvals on or after July 1, 2023, and does not override public health rules like water and sewage. To keep the protection, active and substantial work must start within 3 years, and any required road, drain, or sewer bond is posted when work starts. Planning boards may define what counts as “active and substantial” work or “substantial completion,” and may extend the 3‑year start deadline for good cause. If a board does not define a start standard, the plan still gets the 7‑year protection. Registers of deeds cannot refuse to record a plan because of laws adopted after approval.
New path for building code appeals
Beginning July 1, 2025, many building and fire code appeals go to the state Building Code Review Board. When a zoning board or selectmen act as the local code appeals board, they may only hear appeals of local amendments; other appeals must go to the state board. Decisions by the state fire marshal and final local code appeals must be appealed first to the state board, then to superior court or the Housing Appeals Board after local remedies are exhausted. Cities and towns may use their zoning board as the code appeals board, which must have 3 or 5 resident members. Abutters may intervene in Housing Appeals Board cases.
