Homeowners: old mortgage liens clear on schedule
The law sets automatic timelines to clear old mortgage liens. Starting January 1, 2028, a lien with no stated term clears 35 years after it was recorded. If the mortgage states a term or maturity, it clears 5 years after that date. The lender and the borrower (or heirs, successors, or assigns) can prevent discharge by recording an extension or an unsatisfied affidavit before the deadline. These must be signed by both sides and recorded in the county registry where the land is. If the extension gives a time period, the lien clears 5 years after that period ends; if not, 5 years after recording. After the deadline, the lien is treated as properly discharged. The law repeals the prior exceptions section on undischarged mortgages. Most of the act takes effect 60 days after passage; the timelines above start January 1, 2028.
