Voters can allow social districts

The law lets towns and cities allow social districts by a local vote. In towns, the question goes on the annual town meeting ballot. In cities, leaders may place it on the regular election ballot, or must do so if 5% of registered voters petition. A public hearing happens 15–30 days before the vote, with notice posted in at least two public places and in a newspaper at least 7 days before. A simple majority approves the change.

Towns can end social districts

A town or city that approved social districts can vote later to end them. It must use the same process: a public hearing, notice, and a ballot question. A simple majority ends local authorization.

Rules for drinking in social districts

If your town allows a social district, it must post clear signs showing the area and the days and hours when drinking is allowed. Signs must list phone numbers for the New Hampshire Liquor Commission and local police, and say you must finish or throw away drinks before leaving unless you reenter the place you bought from. The town must post a management and cleanup plan and a boundary map online, and send a detailed map with hours to the Liquor Commission before allowing drinking. You may only drink during the local hours and only if you bought it from a licensed place in or next to the district, in the required cup. You must finish or dispose of the drink before you leave the district, unless you go back into that business. This does not change state limits on alcohol sales or serving hours. The Liquor Commission can adopt rules, and the law takes effect 60 days after passage.

Bar and restaurant rules in districts

Only certain on‑premises licensees may sell drinks for use in a social district: on‑premises beverage and wine; on‑premises beverage and liquor; on‑premises cigar, beverage, and liquor; brew pubs; and on‑premises cocktail lounges. They must sell and serve the drink on their licensed premises. Cups used in the district cannot be glass, must show the seller and a district logo, must say "Drink Responsibly -- Be 21." in at least 12‑point type, and hold no more than 16 ounces. A business in or next to a district cannot let someone enter or reenter with alcohol not sold by that business.
