Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 1 costs, 1 mixed.

Limits on lawsuits over energy policy

The law bars civil lawsuits based only on a state agency acting inconsistently with this energy policy section. People and businesses cannot use such acts or omissions to get damages or court orders. Any challenge must rely on other legal grounds.

Power plant risk reporting and state action

Power plants in New Hampshire must tell the Department of Energy within 30 days if an outside regulator’s action makes staying open uneconomical or could force retirement. After notice, the department opens an investigatory docket to study how a shutdown would affect energy reliability and affordability. It can recommend steps to defend the plant, including asking the Attorney General to go to court or join administrative cases. The Department of Energy and the Department of Justice can ask the Legislative Fiscal Committee for money to carry out these actions. These steps aim to keep power reliable and affordable, but they add a reporting duty for plants.
