Fairer hearings in educator discipline

Beginning January 1, 2026, in any disciplinary hearing, a hearings officer may issue subpoenas for witnesses or records for either the Department or the educator. The party who asks for a subpoena pays the costs unless the officer decides otherwise. Any subpoenaed evidence that matters in the case is shared with both sides.

New subpoena rules in educator probes

Beginning January 1, 2026, the Education Department commissioner or a designee can seek subpoenas in educator code-of-conduct investigations. A hearings officer must find the request is in good faith and the information is likely material and relevant before issuing one. Minimum response times apply: at least 48 hours for people and at least 15 days for documents. Service on licensed or certified educators is by certified mail to the address on file or by hand, and those educators do not get witness or mileage fees. You may file to quash or change a subpoena within 10 days; the officer rules promptly and sets any deadline for compliance.
