New landfills must have leachate plan
Beginning 60 days after passage, the department does not issue permits to build a new landfill without a detailed leachate plan. This rule does not cover expansions of existing landfills. The plan must explain on-site collection and storage, how leachate is moved off-site, and where and how it is treated or disposed. It must list enforceable contracts with haulers and processors that cover the landfill’s operating life and post-closure, show enough transport and processing capacity, state trips per month, and include backup plans. Operators may change or end these contracts only if they file new ones that meet the same rules. If the plan is missing, the permit is denied.
