Outside work or classes count full days
Each calendar day an inmate spends any time working or in post-secondary classes outside the prison counts as one full day served. These days count the same as days inside. This can shorten custody time and move release dates earlier for those who qualify.
Work or college release from prison
The law lets people in New Hampshire state prison leave to attend post-secondary school in the community if accepted. It also lets inmates who volunteer work outside the prison when the job is in their and the state’s best interest. Jobs can be with the state, public, or private employers. All releases follow rules set by the Commissioner of Corrections.
Notice, hearings, and penalties for release
If a prisoner is not yet parole-eligible, the court and prosecutor must be notified before release. They have 10 days to object. If the prosecutor objects, they must explain in writing, and the court must hold a hearing within 10 days and then approve or deny release. If someone on work or school release escapes or fails to return, or someone on home confinement leaves without permission, they are punished under RSA 642:6. The Commissioner of Corrections can recall a person from release if public safety may be at risk.
