Higher fines and license loss for reckless driving
Beginning January 1, 2026, reckless driving carries higher penalties. A first conviction has a fine of at least $500 and up to $1,000, plus the penalty assessment, and a 60-day license revocation. A second conviction has a fine of at least $750 and up to $1,000, plus the penalty assessment, and a license revocation from 60 days to one year.
Higher fines for negligent driving
Beginning January 1, 2026, negligent driving fines increase. A first conviction has a fine of $250 to $500. A second or later conviction has a fine of $500 to $1,000.
Second DUI: 5 days jail and treatment
Beginning January 1, 2026, if your prior DUI was more than 2 but no more than 10 years earlier, the sentence is 17 days in county jail with 12 days suspended. You serve 5 days. The court refers you to the Impaired Driver Care Management Program for a full substance use evaluation. You must schedule the evaluation within 30 days of release and finish it within 60 days. You must follow the service plan, or the court can impose the suspended time.
Online victim panel required for DUI and reckless pleas
Beginning January 1, 2026, courts require a qualified online victim impact panel for DUI convictions and repeats, and for reckless driving pleas that began as DUI charges. The program runs online 24/7 in English and Spanish and gives help to finish. It takes at least 3.5 hours and includes at least eight true victim and offender stories. It checks attention and understanding, verifies identity, and follows up at six months. You get a completion certificate with the provider’s business ID; extra copies are available for you and probation. If the court finds you indigent, it is free; courts can require a fee if you can pay. The program does not bill the state.
