Adults can get needed sterilizing care
If you are 18 or older and have a qualifying medical condition, you can get medically advisable care even if it causes sterilization. Doctors cannot refuse based on your age, how many children you have, marital status, or your stated fertility goals. A medical condition can include diseases, disorders, symptoms, genetic risks, family history, or medicines that affect reproduction. Covered care can include hysterectomy, oophorectomy, orchiectomy, salpingectomy, endometrial ablation, and fertility‑affecting medicines. Gender dysphoria alone does not qualify, but it cannot be used to deny care if you otherwise qualify. The law takes effect 60 days after passage.
Lawsuits barred after consenting to care
If you signed an informed consent or waiver and went ahead with treatment, you generally cannot sue a provider or hospital for being sterilized or unable to have children. You can still sue if the provider acted on purpose, was reckless, or was negligent.
Board review if care is denied
If a doctor denied you qualifying reproductive care, you can ask the New Hampshire Board of Medicine to review it. You must ask within 3 years of the last denial. The Board can investigate, discipline the provider, and assess fines for violations.
