Full homestead protection for medical debts
Beginning January 1, 2026, if a debt comes from unpaid medical bills or a terminal or catastrophic illness or injury, you can claim the full market value of your home as a homestead exemption. For these debts, there is no $1,000,000 cap.
Homestead protection raised to $1 million
Beginning January 1, 2026, the homestead exemption is $1,000,000. It covers your ownership interest in your primary home, including manufactured homes, mobile homes, housing co-ops, and condos you own and live in. For manufactured homes on land you do not also own, the land itself is not exempt. A married couple or a single person can hold only one exemption, up to $1,000,000.
Stronger homestead notice at sale
Beginning January 1, 2026, the notice for a court-ordered home sale must state the $1,000,000 homestead exemption and how to claim it. If you tell the county sheriff and the judgment creditor in writing before the sale, the sheriff pays your exemption amount from the sale first. If the creditor challenges your claim in court, the sheriff holds the money until the court rules. If you notify after the sale, the creditor does not have to pay the exemption until the one-year redemption period ends.
New residency and reinvestment rules
Beginning January 1, 2026, you must have used the home as your primary residence for the past 12 months to claim the homestead exemption. If you sell a qualifying home, the sale money and your new home stay protected if you reinvest the proceeds within 6 months. If you do not meet these timelines, you can lose that protection.
