Education tax delay for some power plants
Beginning July 1, 2027, a power plant that is exempt from the state utility property tax and had a PILOT deal in place on January 1, 2027 does not owe the statewide education property tax. The break lasts until that PILOT ends or January 1, 2031, whichever comes first. When the education tax starts, it can be put into a new PILOT or paid on top of the PILOT. If paid separately, the tax is based on the plant’s imputed value set by the tax department.
No state education tax on utility-taxed property
Starting July 1, 2027, people and property taxed under the state utility property tax are not also charged the statewide education property tax. Local school, city, district, and county taxes still apply. The transition rule for certain PILOT agreements in state law still applies.
Power generation equipment exempt from utility tax
Starting July 1, 2027, property used to generate electricity, when owned by entities defined in state law, is excluded from the state utility property tax. That equipment is no longer treated as utility property for that tax, changing how those assets are taxed.
New yearly filing for exempt power property
Starting July 1, 2027, owners of property excluded from the utility property tax must file a form each year by May 1. The form must list utility and non‑utility property and be signed under penalty of perjury. Owners must also keep an inventory of assets that are and are not subject to the tax. Owners may request up to two written extensions per tax year, up to 30 days each.
