Health plans must post online price files
Health plans must post three machine‑readable price files on a free, public website. One file shows in‑network dollar rates for covered services. One file shows out‑of‑network allowed amounts and billed charges for a 90‑day window that starts 180 days before posting. One file lists drug rates and recent net prices for the same 90‑day window. Plans must update these files monthly and show the last update date. Data is not shown when there are fewer than 20 claims or when privacy laws bar it. These rules apply to plan years starting January 1, 2026, after federal guidance takes effect.
State creates online health price tool
Health plans must send pricing data to the insurance commissioner in a standard format set by rule. The rules align with updated federal guidance. The commissioner compiles the data and publishes a public online tool to compare prices across plans and providers. The tool aims to give clear, accurate, and usable price information.
Transparency rules start after federal guidance
Section 1 takes effect six months after federal guidance under Executive Order 14221 is finalized. The insurance commissioner must notify the secretary of state and legislative services when that guidance is final; that notice starts the six‑month clock. The transparency rules apply to plan years beginning on or after January 1, 2026. The rest of the act takes effect upon passage.
Plans can delegate; quick fixes excused
A health plan can sign a written agreement for another party to post the required files. The plan stays responsible for missing or wrong data. Honest errors or temporary website outages do not count as violations if fixed as soon as practicable. Plans may rely on others’ data unless they knew it was wrong. These rules apply for plan years starting January 1, 2026, after the federal‑guidance timing.
