Ban on electronic license data scans
Beginning 60 days after the law’s passage, no one may scan, record, keep, or store personal information from any license in electronic form. People may share that information on paper, but if it is not going to police, the license holder must consent. The ban has narrow exceptions set in this law.
Safe harbor for alcohol and tobacco ID checks
Beginning 60 days after the law’s passage, sellers of alcohol or tobacco who use due diligence in checking IDs are not responsible if a fake ID is accepted. When due diligence is used, the unauthorized purchaser is liable for any fine or penalty.
Rules for ID scans by secondhand dealers
Beginning 60 days after the law’s passage, pawnbrokers, scrap metal dealers, and other secondhand dealers may scan a seller’s license electronically during a sale with the seller’s consent. They may send that data to police databases only to help find sellers of stolen goods. Dealers may not keep electronic copies they sent to police unless local rules require it, and may share them only with law enforcement. They may keep a paper log with the seller’s name, address, and item details and must show it to police on request.
Brokers may scan IDs for closings
Beginning 60 days after the law’s passage, a licensed real estate broker may scan your license with your consent to confirm ownership during a property sale. The broker must delete the scanned license by the closing date, or sooner if you ask.
