Open-enrollment tuition and district payments
If your child attends an open-enrollment school in your home district, the district cannot charge tuition. When a student attends an open-enrollment school in another district, the home district pays the receiving district at least 80% of its own average cost per pupil. The Department of Education calculates that average using the most recent data from the home district. Receiving schools can also choose to charge less than the usual statutory tuition.
Special education stays a district duty
If a child with a disability attends a chartered public or open-enrollment school, the home school district pays for services and makes education decisions. The district follows Department of Education standards. Parents keep the same options they have now.
Funding sources and budgets for open enrollment
The Commissioner of Education applies for all federal funds available to open-enrollment schools and spends them as the funder allows. A sending district may give extra money, services, equipment, materials, or staff to an open-enrollment school if that fits its local policies. Each district must list estimated open-enrollment tuition as a separate line in its yearly operating budget.
What counts as open enrollment
The law defines an open-enrollment public school or program as a public school that also accepts students from other attendance areas in its district and from outside the district.
