Bill Overview
Analyzed Economic Effects
4 provisions identified: 2 benefits, 1 costs, 1 mixed.
Respiratory students may train without license
If you are matriculated in a board‑approved respiratory care degree program, you may complete supervised clinical training without a license. The services must be part of your course’s clinical work. You must be under the direct supervision of a respiratory care practitioner or a physician.
Temporary licenses for respiratory students
If you are enrolled in a respiratory care program, you can apply for a temporary student license. With this license, you may work in a healthcare setting only under a licensed respiratory care practitioner’s supervision. You may do only tasks where your competency is documented, and only within time limits set by rule. The executive director, with the advisory board, adopts rules for scope, supervision, proof of skills, and timing. The law defines a “respiratory care student” as someone enrolled in a respiratory care education program.
Respiratory employers must keep license records
Each licensee must give their employer a copy of their license, conditional or temporary license, current renewal verification, or proof of reinstatement. Employers must keep a list of everyone providing respiratory care at the facility. The executive director may review the list on request. Copies of licenses must be available for public review on request.
Law takes effect in 60 days
The law takes effect 60 days after its passage. All parts apply on that date unless a section says otherwise.
