Zoning boards: 5 local members, no dual roles

The law requires every zoning board of adjustment to have 5 members. Each member must live in the municipality. A person cannot serve on both the zoning board and the planning board at the same time. The law takes effect 60 days after passage.

Planning board cross-service rules and limits

In cities and towns, up to two appointed or elected planning board members may also serve together on another municipal board or commission. But only one planning board member may also serve on the conservation commission, the local governing body, or any local land use board. No planning board member may also serve on a zoning board of adjustment. In counties with unincorporated towns or unorganized places, county commissioners decide who may serve on other boards, but never on the zoning board of adjustment.
