Deadlines and free fixes for records
Providers must deliver requested records within 30 days of getting your request. If they miss 30 days, the records are free, unless a force majeure made them inaccessible or undeliverable. If the first copy is incomplete, follow-up copies to finish the request are free. When your health care provider requests your records, the sending provider must transfer them within 14 days at no cost.
Lower copy fees and e-delivery
Electronic copies cost no more than $50 total. Paper copies cost $5 for page 1, $0.41 for pages 2–50, and $0.30 for page 51 and up. If you ask for redactions, labor can be billed up to $25 per hour. If records are stored electronically, they must be sent electronically unless you ask for paper.
You own your medical records
The law says you own the medical information in your records. You or an authorized requestor can get a copy under HIPAA rules. A requestor can be your personal representative, your health care provider, someone with a valid power of attorney, or your attorney.
When these rules start to apply
The law takes effect 60 days after its passage. All other rules apply starting on that date.
