Electronic vehicle titles and faster lien release
The law recognizes both paper and electronic vehicle titles. The DMV sends titles to the first lienholder, or to the owner if no lien. If a dealer pays off a lien, the title can be sent to the dealer. After a sale, once DMV gets the assigned title, an application, the fee, and other required documents, it issues a new title and sends it to the first lienholder or the owner if none. For electronic titles, after payoff the lienholder must notify DMV within 10 days after demand, and DMV then sends the owner a clear title.
Who runs the electronic lien system
The law names who can run the electronic lien and title system. An ELT hub is a contracted agent that links the DMV, lenders, licensed dealers, and approved service providers. ELT service providers are approved contractors for lenders or licensed dealers who use the hub to process title and lien messages.
Tighter data rules for vehicle titles
The ELT hub and its service providers may use vehicle and title data only to issue titles and to create, transfer, or release liens. They may share data only among the DMV, New Hampshire licensed dealers, and lenders with an interest in a titled vehicle. They cannot pass this data to anyone else. The hub must make sure it and its providers follow these rules and contract security. If the commissioner finds a violation, they can order the hub or provider to stop getting motor vehicle records starting 10 business days after the order, for up to 5 years unless fixes are in place.
