New Hampshire bans unfair home service contracts

Beginning January 1, 2026, the law bans unfair service contracts tied to a New Hampshire home with 1–4 units. A contract is unfair if it claims to run with the land, lets a provider assign it without your notice and consent, or creates a lien or other property interest. The law defines who is covered and what counts as a service agreement. It exempts home warranties, insurance, options or rights of first refusal, common-interest community declarations and HOA repair deals, mortgages and commitments, Uniform Commercial Code security agreements for personal property or fixtures, and regulated utilities. It does not change mechanics’ lien rights.

Stronger remedies for unfair home contracts

Beginning January 1, 2026, it is an unfair or deceptive act to make or try to make an owner sign an unfair service contract. No one may record an unfair service contract or a notice of it; doing so is a Class A misdemeanor. County registrars may refuse to record these documents. If one is recorded, it does not give legal notice to buyers or lenders. Anyone with an interest in the property can ask district court to declare it unenforceable and can recover proven actual damages, costs, and attorney’s fees from the provider who recorded it.
