New disclosures for resident-owned community buyers
Beginning January 1, 2026, buyers of a resident-owned community unit in a resale (not from the original developer) have a right to key disclosures. You must send a written request before signing the contract. The association’s designated officer must provide the documents within 10 days of getting your request. Disclosures include: any unpaid fees on the unit; planned capital and major maintenance costs for this year and the next two years; reserve fund balance and earmarks; last year’s income statement and balance sheet; pending suits or judgments; insurance the association carries and typical owner coverage; whether past alterations break the community rules; the declaration, by-laws, and formal rules; and current monthly or annual fees and any special assessments from the last three years.
