State lab testing fees by rule
The law requires DHHS to list state lab services and set a fee schedule by rule. The commissioner can waive fees when it protects public health. Fees for Safe Drinking Water Act testing use the same cost method as EPA grant reimbursements. These rules apply beginning July 1, 2025.
When the new lab system starts
Most of the law takes effect July 1, 2025. Sections 2, 3, and 5 start only after the DHHS commissioner certifies in writing that the new lab services and fee rules are adopted. When certified, the old water testing and fee statute (RSA 131:3-a) is repealed.
Half of lab fees buy equipment
Beginning July 1, 2025, fees from public or private clients go to the state, and 50% of each analysis fee goes to a new lab equipment and replacement fund. Fees from grants or other state agencies are credited against the state lab’s operating costs. The fund does not lapse and buys or replaces lab equipment. With approval from the governor and council, it can also cover unplanned staff or supply needs.
New water testing rules for pools and beaches
When DHHS certifies the new lab fee rules, public bathing facility owners must pay sampling costs set under those rules. The state deposits those payments as RSA 131:4 provides, including any share for the equipment fund. A town with a testing program equal to the state’s is not subject to extra state sampling.
