Hospital payment authority ends July 1, 2032
On July 1, 2032, the law repeals the hospital Medicaid payment section. This ends the legal authority for those hospital payments unless a future law replaces it.
Medicaid hospital pay tied to prior collections
Beginning in state fiscal year 2026, DHHS pays hospitals 80% of the prior year’s RSA 84‑A collections. The commissioner chooses the mix of payment methods to maximize federal match and avoid overall cuts. All payments need CMS approval and federal funds; the state does not pay beyond available federal money. Hospitals are not owed amounts they fail to earn under CMS‑approved directed payments. One percent of hospital‑payment funds is set aside for DHHS administration. Before changing methods, DHHS sends details to the fiscal committee for information. Most provisions take effect July 1, 2025.
New fund and 20% for Medicaid services
On July 1, 2025, the state creates the Uncompensated Care and Medicaid Fund. It holds RSA 84‑A money, does not lapse, and earns interest. DHHS uses it with federal match for provider payments and Medicaid services. At least 20% of prior‑year RSA 84‑A collections must support Medicaid services and programs. Priority goes to community mental health centers, FQHCs, and substance use disorder providers.
New DSH fund and tighter eligibility
On July 1, 2025, the state creates a separate DSH fund inside DHHS. All DSH revenue goes into it and is redistributed to meet federal reviews. DSH payments go only to hospitals that meet federal DSH rules. Uncompensated care includes charity care and unreimbursed Medicaid costs that meet federal tests.
Only general acute hospitals get payments
The law defines a hospital as a general acute care hospital licensed under RSA 151. Government hospitals and rehab‑only hospitals are excluded. A facility must meet this definition to get payments under this section. This takes effect July 1, 2025.
