Stricter rules for controlled drug prescriptions
Prescriptions must be clear and list the patient’s name and address, issue date, one drug, strength, and directions. They must also include the prescriber’s DEA number, full name, and a signature dated the day issued; animal prescriptions must list the species. No refills are allowed for Schedule II drugs, and doctors cannot prescribe to themselves or immediate family. A prescription is invalid if not filled within 6 months. Issuing or filling a noncompliant controlled-drug prescription is a misdemeanor.
Limits on controlled drug fills
Most Schedule II and III controlled drugs are capped at a 34-day supply per fill. Some packaged products that need dose integrity, like inhalers or metered topical pumps, can be filled for up to 60 days in the smallest package. Amphetamines and methylphenidate can be filled for up to 90 days if the prescription says it treats ADHD or narcolepsy. Topical androgens can be filled for up to 90 days if the prescription is for chronic low testosterone therapy.
Clear rules for selling controlled drug stock
When stopping controlled-drug sales, the legal owner may sell remaining stock only to a manufacturer, wholesaler, or registered pharmacy. The transfer requires an official written order and must follow federal controlled-substance law. A licensed pharmacy may also sell Schedule II drugs to a practitioner for medical use with an official written order.
Pharmacists can dispense and administer more drugs
Licensed pharmacists may sell, dispense, and administer certain controlled drugs with a proper written or electronic prescription. Oral orders count only when federal rules allow, and the pharmacist must promptly write them down with required details. Hospital pharmacists may dispense cannabis type drugs on an attending physician’s properly executed prescription and must date and sign when filled. Payment for pharmacist administration services is made at rates the department sets under RSA 161:4, VI(a).
Pharmacies must keep detailed records
A pharmacy must keep each controlled-drug prescription on file and open for inspection for 4 years. The person who fills it must note the fill date and their name on the record. For each refill, record the refill date, quantity dispensed, and the refiller’s initials.
