Clear gift card terms and start date

The law defines who is a cardholder, card issuer, and gift card seller. It defines open-loop and closed-loop gift cards and gift card redemption information. It sets how value is measured for penalties: the greatest reasonable loss, including the full face value. All rules take effect January 1, 2026.

Harsher penalties for fake receipts

Beginning January 1, 2026, the law makes it a misdemeanor to possess, use, make, alter, or copy retail receipts or UPC labels to steal from a store. It becomes a class B felony when five or more receipts or labels are involved, or when someone has a device to make counterfeit ones. These rules target organized receipt fraud and protect retailers and shoppers.

Stronger penalties for gift card fraud

Beginning January 1, 2026, the law makes it theft to get or keep a gift card or its redemption data without consent, with intent to defraud. It bans tampering with a gift card or its packaging to defraud. It criminalizes schemes that use lies to obtain gift cards or redemption data. Using stolen gift cards or redemption data to get money or goods is also theft. Penalties scale by value taken in any six months: over $1,500 is a class A felony; over $1,000 is a class B felony; less is a misdemeanor.
