Repairs and limits for over-water homes
The law lets owners fix or modernize existing homes built over New Hampshire waters, as long as the use stays the same. Owners can update interiors or cribwork and use modern materials. They cannot expand the footprint or add interior living space. Adding a code-required exit is allowed and not counted as expansion. Approval requires an approved sewage disposal system. Routine maintenance that does not involve work in the water needs no permit. The Environmental Services Commissioner can waive some standards only for changes that better protect public water. A waiver cannot harm the environment, convert a water activity to a land-based home or business, or increase the footprint or living space.
