Health facilities must report violence

Health facilities must file a yearly report to the state safety commission on all workplace violence and “hostile words” incidents against staff. The Department of Labor must set one common form. Once those rules are in place, facilities use that form to send monthly incident reports. Each report must list what happened, risk factors, date, time, place, injuries, who did it by type, how it was handled, and the yearly share of staff in the prevention program.

Privacy and no retaliation for reporters

Reports must keep “workplace violence” and “hostile words” as different categories. They cannot include names or other personal details unless those appear in an attached police or other official report. The confidentiality rules in RSA 151-J:5 apply to these records. No one may retaliate against a person who in good faith reports an incident or uses rights under this law.

Public reports and state facilities covered

The Health Care Workplace Safety Commission issues a public yearly report to state leaders. The public report uses only aggregate data and does not name people, patients, providers, or institutions. State-run medical facilities are now under the commission and must follow the same safety and reporting rules as other facilities.

Workers must still do normal duties

The law does not let employees refuse ordinary and customary job duties. Employers may still require normal work, even when incidents are reported.
