Guaranteed special education aid to districts

Beginning July 1, 2025, the state pays special education aid as an entitlement. A district qualifies when one student’s special education costs it must cover are over 3.5 times the prior year’s state average per‑pupil spending. The State Board of Education, through the Commissioner, distributes this aid. If the yearly appropriation is short, the Governor issues a warrant from the Education Trust Fund to pay in full. If that fund goes negative, the Comptroller moves money from the General Fund, and the Department of Administrative Services reports the balance, but payments are not delayed.

Emergency help for high special education costs

Beginning July 1, 2025, the state can set aside up to $250,000 each year for emergency special education help, plus up to $250,000 more for communities of 1,000 or fewer people. Districts apply and need approval by the Commissioner under State Board rules. At year end, any unspent special education aid is used for court‑ordered placements and treatment. If emergency‑set‑aside money goes unused, the state redirects it to help districts cover rising special education costs. A district that gets emergency funds for a child cannot also get regular special education aid for that same child.
