New fines for shoreland contractors
Beginning January 1, 2026, contractors who supervise or do work that violates the Shoreland Water Quality Protection Act face fines. The Superior Court can levy civil penalties up to $5,000 for each violation after a petition by the attorney general or the town. The court can also order work to stop and require cleanup. The Commissioner can impose administrative fines up to $5,000 per offense after notice and a hearing under RSA 541-A. You may seek rehearing or appeal under RSA 541. An administrative fine does not prevent civil penalties. For repeat violations, each prior violation doubles the allowed administrative fine, which can exceed $5,000.
