File death affidavit for transfer-on-death deeds
If you inherit real property through a transfer-on-death deed, you must file a notarized notice-of-death affidavit within 60 days of the transferor’s death. File it at the county registry of deeds where the property is located. The affidavit must list each beneficiary, the property’s street address, the deed’s date and its recording book and page, the deceased transferor’s name, date and place of death, and a mailing address for future tax bills. After recording, the registry returns the original to you and sends a copy to the local tax assessor. Filing this affidavit is not required for title to pass. The law takes effect 60 days after passage.
