Court review for Nevada license applicants

Individuals denied a Nevada professional or occupational license because of moral character or criminal history can seek district-court review. This right does not cover State Contractors’ Board licenses under Chapter 624. Before its final denial, the licensing agency must explain available administrative appeal steps and deadlines. It must send written reasons within 10 days after issuing its final denial. Applicants have 30 days after receiving that notice to file for court review. The court must schedule a hearing. The agency must prove that issuing the license more likely than not poses a direct, substantial public health or safety risk. That risk must stem from the job’s duties and cannot be reduced. The agency can present relevant evidence, but prior arrests alone are not enough. If the agency fails to prove its case, the court must order the license issued, and the agency must comply despite other laws. Otherwise, the court must uphold the denial with specific findings of fact and legal conclusions. It can also require the agency to discuss with the applicant what actions are needed to get the license.
