Online service of process for businesses

Starting 180 days after enactment, you can serve legal papers online through the New York Department of State when the Secretary of State is the entity’s agent. This covers corporations, LLCs, nonprofits, partnerships, and condominium boards registered in New York. Service is complete only when the Secretary of State reviews and accepts your electronic filing. After acceptance, the Department promptly mails a certified copy to the address on file or emails a notice and makes the papers available. Email notice works only if the entity listed an email address with the Department. You must pay any required statutory fee, which counts as a taxable disbursement. Using the online option does not add extra cost, and it is allowed for cases by the State or local governments and in lower courts when the claim and the office are in that court’s area.
