Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 1 costs, 2 mixed.

Stronger oversight and staff background checks

Licensed facilities must provide financial, statistical, and program reports when requested, and they can be audited on site. Providers must run criminal history checks for new staff or volunteers who will have regular, unsupervised contact with clients. The Office of Mental Health and the Office of Addiction Services and Supports, in consultation with the Justice Center, set the steps providers must follow to meet these requirements.

One license, no duplicate certificates for integrated care

The law creates one joint license for programs that combine mental health, addiction, and related physical care. Providers authorized under these integrated rules do not need separate operating certificates from the Department of Health, the Office of Mental Health, or the Office of Addiction Services and Supports. Integrated programs face no cap on how much primary care or mental health care they can provide. Only providers with proven experience in both mental health and addiction care qualify for this license. The law also adds integrated behavioral health programs to the Social Services Law so they are clearly recognized.

Payment floor and rate rules for integrated care

Payments for integrated behavioral health services must be at least the ambulatory patient group (APG) rate for similar services. Government payments to facilities licensed by the Office of Mental Health or jointly under the integrated program use rates certified by the proper commissioner and approved by the state budget director; rates can vary by region. The law takes effect when those rates are certified or when the required regulations become effective, whichever is later.
