Bill Overview

Analyzed Economic Effects

5 provisions identified: 0 benefits, 1 costs, 4 mixed.

Enforcement photos not public records

Photos and videos from this program are exempt from public records requests. The public cannot get these images under the usual disclosure law.

Camera ticket costs and your record

If a camera shows a red-light violation and the car was used with the owner’s permission, the registered owner must pay a civil penalty. Each violation can cost up to $50. A local law can add up to $25 more if you fail to respond on time. The owner is not liable if the driver is convicted for the same violation. This is not a criminal conviction, does not go on your driving record, and insurers cannot use it.

How to contest a camera ticket

The town sends notices by first-class mail, and a mailing record proves it was sent. The notice must name you, list the plate, location, date and time, give the camera ID, and explain how and when to contest. A sworn town technician’s certificate and the photos or video are treated as proof, and the images are available to inspect. Cases are heard by the traffic violations bureau or, if none, the local traffic court. You can defend your case by showing the signal was malfunctioning, or by mailing a certified police report if the car was reported stolen before the event and not recovered.

Who owes: owners, renters, drivers

If you were not driving, you can seek repayment from the driver. The law presumes the driver had your consent, but you are not liable if you prove the driver used the car without your consent. Rental car owners can avoid liability by sending the renter’s name and address within 37 days. If the lessor sends it on time, the renter is treated as the owner and gets the notice.

Time-limited red-light cameras in Woodbury

The town of Woodbury can run a red-light camera at State Route 32 and Woodbury Outlets Boulevard North. The program needs written approval from the state DOT, and DOT can change or end approval at any time. The town must use competitive bidding to buy or lease the cameras. The law starts 30 days after enactment and ends December 31, 2030.
