Farm group coverage falls outside insurance rules
Qualifying nonprofit farm groups can offer health coverage outside Ohio insurance laws and related health-plan rules. Groups must have been incorporated in Ohio by December 31, 1919, to promote Ohio farmers’ interests. Coverage is limited to members and their families, through written contracts with the group or its affiliate. Applications must also be written. Applications and contracts must prominently say the coverage is not insurance and is not subject to Ohio insurance laws and rules. Groups cannot call it insurance in official written or spoken marketing to prospective members or members’ families. An insurer authorized in Ohio can take on or reinsure the coverage risks, but is not required to.
