Home sellers gain wholesaler disclosure remedies

Owners of covered Ohio homes with one to four units can cancel without penalty before escrow closes when required wholesaler disclosures are missing. Within 30 days after cancellation, the escrow or closing agent must pay the wholesaler's earnest money to the owner. Affected parties can sue under Ohio consumer-protection law, and the Attorney General can enforce the rules. Attempts to waive or change these duties or remedies are void. The Ohio Real Estate Commission can also discipline licensed real estate professionals who break the rules while acting as wholesalers. These protections exclude specified contract transfers to blood relatives or related companies under common control.

Home sellers get wholesaler contract disclosures

For Ohio homes with one to four units, wholesalers acting as buyers must give owners a separate, clearly visible disclosure. It must use bold type of at least 12 points, and both sides must sign and date it before a binding contract. The disclosure explains that the wholesaler does not represent the owner and can transfer the contract without the owner's consent. It also warns that the price may be below market value, the wholesaler can charge another buyer a fee, and owners should seek professional advice. Wholesalers enter purchase contracts for a fee, or expecting one, then transfer or replace those contracts with another party. Transfers to blood relatives or a parent, affiliate, subsidiary, or affiliated group under common control are excluded.
