Beginning January 1, 2026, Oklahoma sets minimum insurer payments for covered out-of-network ambulance services. Insurers must use the local government’s set or approved rate where the service starts, submitted by May 1, 2025. Without a qualifying local rate, the minimum is the lower of 325% of the current federal Centers for Medicare & Medicaid Services rate for that service and area or the provider’s bill. Providers must accept payment under these rules as payment in full and cannot bill patients beyond the insurer’s payment. Patient copays, coinsurance, deductibles, and other cost-sharing cannot exceed in-network amounts for the covered service. By January 1, 2026, the Oklahoma Insurance Department must maintain a public online rate database; local governments or providers acting for them can submit rates annually in the Insurance Commissioner’s required format. Insurers must follow posted rates and Oklahoma’s claim-payment rules. The Department must review the data and report to the Governor and legislative leaders by January 1, 2027. These payment rates expire unless Oklahoma lawmakers modify them before December 31, 2027.
