24-hour police reporting by school employees

All public and private school employees must report to local law enforcement within 24 hours when they learn or are told a student may be a victim of sexual abuse, sexual assault, or sexual misconduct. This is on top of any other required reports. The report must go to an agency independent of the school; a school resource officer does not count unless that agency directs them, and then the SRO must send a written report back. Schools must tell police before starting any formal interviews or discipline and must wait for police to have a chance to interview, unless police say the school must act at once to protect students. Law enforcement keeps the reporting employee’s identity confidential, and school staff may not reveal it except by court order or to investigators. Every school employee must sign a yearly statement acknowledging this duty; not signing does not remove the duty or any criminal liability.

School staff must include parents in messages

If you work for a public or charter school and message a student one-on-one, you must include the parent or legal guardian. This does not apply when you use a school-approved platform for school or class matters. In an emergency, you may contact the student first, but you must tell the parent after. Schools must train staff on these rules. If someone reports a violation, the employee is placed on administrative leave during the district investigation. If cleared, they return and the incident is noted; if misconduct is found, they can be disciplined up to termination, and police are notified right away when sexual or unlawful behavior is involved.

Law takes effect immediately

The law takes effect upon passage and approval. All parts apply right away unless a section says otherwise.
