Category B bond amounts now depend on how many wells you run and your Form 1006B year. For 1–10 wells it is $25,000. For 11–50 wells: $33,300 in 2026, $41,600 in 2027, and $50,000 in 2028. For 51–100 wells: $50,000 in 2026, $75,000 in 2027, and $100,000 in 2028. For more than 100 wells: $66,500 in 2026, $108,000 in 2027, and $150,000 in 2028. By the end of 2028, you must post the full amount. The Commission can require more, up to $150,000, after notice and hearing for pollution or bad plugging. You may post less than the standard amount if a licensed well plugger certifies your current statewide plugging costs are lower; that reduced amount must cover the estimate and can be raised if you add operations.
It is illegal to drill or operate without the required proof of money to plug wells and close impoundments. The Commission can shut in your wells right away without notice or hearing, and they stay shut until your Category B surety is posted and verified. If you fail to plug, close, or remove equipment after notice, the Commission can take money from your bond or make you pay the costs. You get 10 days from the notice to start the work. Forfeited money pays the work and extra goes to the Oil and Gas Division Revolving Fund; the Commission can recover litigation costs. If you buy a well or property, you must provide the required financial proof before the transfer. The law defines “affiliate” (20% ownership link) and “insider” (officers, directors, controllers, partners, certain spouses, related entities, and managing agents) for enforcement under these rules.
Beginning November 1, 2025, new operators cannot choose the Category A net-worth option. If you already have a valid Category A and are in good standing, you can keep it. You may switch to Category B by sending written notice to the Commission. If you switch, you can switch back to Category A within three years by written notice and by staying in good standing. After three years, the switch to Category B is permanent.
