Stronger payment enforcement for seed growers

When the Department finds a dealer missed a due payment, the dealer must pay all overdue amounts within 30 days. Interest is bank prime plus 1% per month, as simple interest, from the final payment date until paid. Within 30 days, the dealer must give the Department proof of payment and interest. If not paid on time, the Department suspends the dealer’s seed license until all payments to growers are current. If a dealer still does not pay as required, the grower is treated as allowed to sell any contract seed they still hold in a commercially reasonable way. Department notices follow Oregon’s administrative hearing rules.

Rules take effect immediately

The law takes effect on its passage. The new payment enforcement rules start right away.

Fees to trigger payment enforcement

The Department may charge up to $100 to check if a dealer paid you under a seed contract. It may also charge up to $400 to send the dealer a written payment deadline. These are maximum fees and apply only if the Department chooses to bill you.
